Terms of Service

By downloading, installing, or using the Fyll mobile application, you agree to these Terms of Service. If you do not agree, do not use Fyll.

Fyll is operated by MPTEE UNIGROUP DISTRIBUTION LLC, a New York limited liability company.

Fyll helps users:

• Log meals through photos or text descriptions
• Review AI-estimated nutrition information before saving
• Track meals, beverages, reflections, and food patterns
• Ask Phine, Fyll's assistant, about logged meals and food-pattern context
• View insights based on logged meals, reflections, profile context, and optional health summaries

Fyll is not a medical device and does not provide medical advice.

To use Fyll, you must:

• Be at least 13 years old or the minimum age required in your jurisdiction
• Be capable of forming a binding contract
• Not be prohibited from using the app under applicable law

If you are under 18, you must have permission from a parent or guardian.

To use Fyll, you must create an account with a valid email address, first name, and password.

Passwords must be at least 8 characters. You are responsible for keeping your login credentials secure and for activity under your account.

You agree to provide accurate information and keep it updated.

You agree to use Fyll only for lawful, personal purposes.

You agree not to:

• Share your account with others
• Attempt to reverse engineer, attack, scrape, or disrupt the app or backend
• Upload malicious files, viruses, or harmful content
• Abuse rate limits, automation, or security controls
• Use Fyll to harass, harm, or mislead others
• Upload content you do not have the right to use
• Use the app for commercial purposes without permission

You retain ownership of meal photos, meal descriptions, reflections, notes, and other content you provide.

You grant Fyll a limited license to store, process, analyze, and display your content as needed to provide the service. This includes sending meal photos, meal descriptions, chat prompts, and relevant context to configured AI providers for analysis or response generation.

We do not claim ownership of your personal data or meal photos.

Fyll uses AI to estimate nutrition, identify food items, support chat responses, and generate food-pattern observations.

You understand that:

• AI outputs are estimates and may be wrong
• Nutrition values depend on available context, image quality, portion assumptions, cooking methods, and hidden ingredients
• You should review and edit estimates before saving when needed
• Similar meals may receive different estimates over time as models and prompts change
• You should not rely on Fyll for critical health or medical decisions

Fyll is not a medical device and does not provide medical advice.

Fyll provides nutrition estimates and pattern observations for educational purposes only. Fyll does not provide diagnosis, treatment, dietary prescriptions, or professional health advice.

Talk with a qualified healthcare professional or registered dietitian before making significant diet, health, or medical changes, especially if you have diabetes, kidney disease, heart disease, an eating disorder, food allergies, pregnancy-related concerns, or any condition requiring medical nutrition therapy.

If you experience a medical emergency, contact emergency services immediately.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.

The current launch draft does not include implemented paid subscriptions, Premium entitlements, in-app purchases, or app-store billing in the codebase.

If Fyll adds paid features later, we will update these Terms, the Privacy Policy, store listings, and in-app purchase disclosures before those paid features become available.

If you download Fyll from the Apple App Store, Apple's applicable terms may also apply to your use of the app.

If you download Fyll from Google Play, Google Play's applicable terms may also apply to your use of the app.

You may stop using Fyll at any time by deleting your account in the app and uninstalling the app.

We may suspend or terminate access if you violate these Terms, abuse the service, create risk for other users, or create legal/security risk for Fyll.

When your account is deleted, data is handled according to the Privacy Policy. Some provider logs, backups, soft-delete storage, or legally required records may remain for a limited period under applicable retention policies.

Fyll is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

We do not guarantee that:

• The app will always be available or error-free
• AI estimates will be accurate or complete
• The app will achieve any health, weight, nutrition, wellness, or performance outcome
• Data will never be lost, though we use safeguards designed to reduce that risk

To the maximum extent permitted by law, Fyll and MPTEE UNIGROUP DISTRIBUTION LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or health outcomes arising from your use of the app.

Our total liability for claims related to Fyll will not exceed the greater of the amount you paid us in the 12 months before the claim or $100 USD, unless applicable law requires otherwise.

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses arising from your use of Fyll, your content, your violation of these Terms, or your violation of another person's rights.

Before filing a formal dispute, you agree to contact hello@fyllapp.com and attempt to resolve the issue informally for at least 30 days.

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles.

Any disputes not resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring claims in small claims court or seek injunctive relief for intellectual property or security violations.

You agree to resolve disputes on an individual basis and not as part of a class action, to the maximum extent permitted by law.

We may update these Terms from time to time. We will update the date above and provide additional notice for material changes where required.

Your continued use after changes means you accept the updated Terms. If you disagree, stop using Fyll and delete your account.

These Terms and the Privacy Policy are the agreement between you and us regarding Fyll.

If any provision is found unenforceable, the remaining provisions remain in effect.

Our failure to enforce a right does not waive that right.

You may not assign these Terms. We may assign them in connection with a merger, acquisition, financing, restructuring, or sale of assets.
